ARTICLE 1. Scope of application
The wwww.trappedevisite.be service is provided by TEMPO MATERIAUX SRL, whose registered office is located at Boulevard Saint-Michel 65 bte.6, 1040 ETTERBEEK, registered under number XXX RCS ETTERBEEK (intra. VAT XXX). The wwww.trappedevisite.be site and its derivatives offer users free access to the Internet, with information available at the time of connection.
These terms and conditions apply to all products marketed and services provided by the wwww.trappedevisite.be site and its derivatives (hereinafter referred to as wwww.trappedevisite.be). All sales made by TEMPO MATERIAUX SRL shall be governed exclusively by the provisions of these conditions, which shall be attached to or accompany any offer or commercial proposal made by TEMPO MATERIAUX SRL.
The purpose of the present general conditions of sale is to govern the contractual relations between the company TEMPO MATERIAUX SRL described above and the Customer defined below as the user of the site wwww.trappedevisite.be and its derived services. By purchasing products online and using the services offered, the Customer declares that he/she is using the wwww.trappedevisite.be services in accordance with the applicable law and the following terms and conditions.
No special conditions shall prevail over the present conditions, unless TEMPO MATERIAUX SRL expressly accepts them in advance and in writing. Consequently, any condition to the contrary opposed by the Customer to TEMPO MATERIAUX SRL will, in the absence of express acceptance, be unenforceable against TEMPO MATERIAUX SRL, regardless of the time or circumstances in which it may have been brought to TEMPO MATERIAUX SRL’s attention.
The fact that the Vendor does not avail itself, at a given time, of any of the present Conditions may not be interpreted as a waiver on its part of its right to avail itself of any of the said Conditions at a later date.

ARTICLE 2. Conditions of use

1. The contractual information is presented in French and will be the subject of a confirmation containing this contractual information at the time of the on-line purchase procedure. TEMPO MATERIAUX SRL reserves the right to cancel any order from a Customer with whom there is a payment dispute, without the Customer being entitled to claim any compensation whatsoever.
2. Validation of the order by the Customer implies full and unreserved acceptance of these General Terms and Conditions. The data recorded by TEMPO MATERIAUX SRL on the wwww.trappedevisite.be site or the transcripts of telephone calls between the Customer and TEMPO MATERIAUX SRL constitute proof of all transactions between TEMPO MATERIAUX SRL and its Customers. The data recorded by the payment system constitutes proof of the financial transactions.
3. The characteristics of the products offered for sale are presented on the website. Photographs are not part of the contract. The seller cannot be held responsible for any errors. All texts and images presented on the site are reserved, for the whole world, under copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden without the formal agreement of the company. Similarly, it is strictly forbidden to set up hypertext links to the site without the express authorization of the company’s legal representative.

ARTICLE 3. Payment and terms of payment
1. Price :
1.1. The prices of products sold on the wwww.trappedevisite.be site are indicated in euros, inclusive of all taxes and exclude shipping costs. All orders, whatever their origin, are payable in euros at the time of ordering.TEMPO MATERIAUX SRL reserves the right to modify its prices at any time in line with changes in market prices.
1.2. To the selling price of the products marketed on the site must be added the cost of delivery to the customer of the products ordered and, where applicable, the cost of consignment of each pallet delivered. The maximum return period for pallets is 12 months from actual delivery. IMPORTANT: Shipping costs are calculated according to the information provided by the customer when choosing products on the site and are updated automatically as soon as new information is provided or new choices are made. The Customer’s attention is therefore drawn to the fact that the cost of transport indicated to the Customer at the time of each product selection is indicative and provisional, and varies according to the place of delivery, the nature and number of items ordered, and the carrier selected. The final shipping costs payable by the Customer are indicated in the Customer’s basket at the end of the product selection process, and are recalled in the order summary that precedes validation.
1.3. Products are always invoiced on the basis of the rates in force at the time the order is registered, subject to typographical errors or changes in VAT applied by France, which would be immediately passed on.The site’s promotional rates apply for the promotional period indicated on the website. Any taxes, duties or other charges payable in application of French regulations or those of an importing or transit country are at the customer’s expense and are added to the sale price.
1.4. In addition to the selling price of the product or service charged by TEMPO MATERIAUX SRL on the Site, a reference price (crossed out) may sometimes appear, which is the price recommended by the supplier of the product or service to distributors in France at the time of sale. If the product or service is no longer subject to a price recommended by the supplier at the time of sale, the above reference price is supplemented by information relating to the year to which this price relates. This information will be specified in the product or service data sheet.In all cases, TEMPO MATERIAUX SRL verifies the reality of the reference price and the fact that it has been or is being applied, as the case may be, by other distributors.When a product or service has been marketed for several seasons by the supplier, the price recommended by the latter may have varied. In such cases, TEMPO MATERIAUX SRL always uses the lowest recommended price communicated by the supplier as the reference price.
2. Payment :
Payment for purchases is made by various means available to the customer:
– By credit card: Carte Bleue, Eurocard, Mastercard and Visa accepted in France. The price quoted must be paid automatically by credit card according to the payment procedure described during the registration process. The Customer is solely responsible for the actual payment of the purchased product. THE USER ALONE IS RESPONSIBLE FOR PAYMENT BY CREDIT CARD FOR THE SERVICE OFFERED. TRAPPEDEVISITE IS NOT RESPONSIBLE FOR PAYMENT PROBLEMS RELATED TO THE OPERATION OF THE E-COMMERCE SERVICE.
– By bank transfer: the Customer undertakes to pay the full amount displayed via his bank, using the bank details provided at the time of ordering, specifying the order number if possible in the transfer information. Shipment time starts upon receipt of the bank transfer.
– By cheque: the customer undertakes to pay the full amount of the order by French cheque within two weeks of cancellation. The shipping period starts from the effective registration of the payment in the bank + 15 days. Payment should be sent to TEMPO MATERIAUX SRL – Service Facturation – Boulevard Saint-Michel 65 bte.6, 1040 ETTERBEEK together with a copy, dated, signed and marked “Bon pour commande”, of the Order Form received by e-mail or downloaded from the customer area and a photocopy of both sides of an identity document corresponding to the identity of the cheque holder.
Confirmation of an order implies agreement to pay the full price and charges for the product purchased, including taxes.
Ownership of the product ordered is not transferred until the sale price has been received in full by TEMPO MATERIAUX SRL. If the Customer accepts an offer of payment by instalments, ownership of the product ordered is transferred only on the date on which all sums due by the Customer are actually received by TEMPO MATERIAUX SRL.
3. Online payment security :
TEMPO MATERIAUX SRL does not store customer credit card information. Secure information is sent directly and only to the banking institution appointed by TEMPO MATERIAUX SRL.
By validating the order form, the Customer guarantees that he/she has the necessary authorizations to use the chosen method of payment.
TEMPO MATERIAUX SRL certifies that payment card details are encrypted using SSL (Secure Soket Layer) protocol, and are never transmitted unencrypted over the network. Payment is made directly to the bank.
Under no circumstances is the personal code requested from the customer, only the 16-digit credit card number, the expiry date and the 3-digit control code on the back of the card.

ARTICLE 4. Availability of products ordered
Product offers and prices are valid as long as they are visible on the site.
In the event of unavailability of the product ordered, the customer will be informed as soon as possible via the customer account and/or by email and will have the option of cancelling the order if the exchange option does not suit him/her. The Customer will then have the option of requesting reimbursement of the sums already paid within thirty (30) days of payment. In case of impossibility of exchange, TEMPO MATERIAUX SRL reserves the right to cancel the order and refund the sums paid. TEMPO MATERIAUX SRL cannot be held responsible for the unavailability of a product, nor can it entitle the Customer to claim damages.

ARTICLE 5. Control
To place an order, the Customer must first identify himself or register on the wwww.trappedevisite.be site. To this end, he fills in a form provided online, according to the instructions provided, in which he enters the information required for identification, in particular his surname, first name, telephone number, postal and e-mail address and billing and delivery address.
Additional information may subsequently be requested to ensure the quality and safety of the delivery. The Customer undertakes to provide TEMPO MATERIAUX SRL as soon as possible with such information and data as TEMPO MATERIAUX SRL may reasonably request. All information is presented to the Customer in French.
When a user benefits from special conditions, these cannot be combined with other special conditions offered on the site or by another wwww.trappedevisite.be partner.
The customer chooses his products and adds them to his basket. The final validation of the order is taken into account after having checked its order, and in particular the final price conditions of delivery, to accept the General Conditions of Sale and to choose a mode of payment.
From this moment, the order is recorded, and an order number is communicated to the Customer as well as a confirmation on screen and/or by e-mail. The data recorded by TEMPO MATERIAUX SRL constitutes proof of the nature, content and date of the order.
Invoices include details of the price of each product excluding VAT and, where applicable, the amount of VAT calculated on the total excluding VAT and included in the total including VAT.
The order is not final until the corresponding price has been paid, it being specified that acceptance of an offer of payment by instalments (credit, deferred payment, etc.) proposed by TEMPO MATERIAUX SRL constitutes payment.

ARTICLE 6. Delivery mode
Products are delivered according to the conditions described when the order is placed.
The Customer shall take all necessary measures to ensure optimal and safe delivery and unloading of the products ordered.
To this end, the “delivery” stage of the wwww.trappedevisite.ber site contains information that must be filled in as carefully as possible, as it will be essential for the delivery to be processed. TEMPO MATERIAUX SRL or the carrier shall not be liable for any errors or omissions in the information provided. In particular, in view of the heavy nature of certain deliveries, access to the carrier’s place of delivery is at the customer’s expense and must be confirmed on the “delivery” form. When placing the order, the customer must also inform us of any special traffic and safety measures in place at the delivery site.
Delivery will be made by the partner supplier(s) to whom all or part of the order has been assigned.
It can only take place once the order has been validated by the Customer and payment (or subscription to a forward payment offer) has been made in full.
TEMPO MATERIAUX SRL will confirm to the Customer by e-mail the actual delivery date, which alone is binding on TEMPO MATERIAUX SRL.
You must be present when the order is delivered to ensure that delivery takes place under the best possible conditions.
Delivery takes place on the property line (“doorstep”), in the open air and without additional handling.
The contents and condition of the packages are deemed to have been accepted by the Customer when the delivery note is signed. In case of doubt, clear and precise reservations can be indicated in the presence of the delivery person on the delivery note before signature. Unloading and signature of the delivery note transfer the risks associated with the product ordered to the Customer. It is reminded that the ownership of the product ordered is not transferred until the sale price has been fully received by TEMPO MATERIAUX SRL. If the Customer accepts an offer of payment in instalments, ownership of the product ordered is transferred only on the date on which all sums due by the Customer are actually received by TEMPO MATERIAUX SRL.
Delivery does not include installation.
Any modification of the delivery address by the Customer once the shipment is in progress may result in an additional cost to be borne by the Customer.
TEMPO MATERIAUX SRL reserves the right to refuse any order from a customer with whom it has an outstanding dispute.

ARTICLE 7. Delivery times
As the products ordered are potentially available from several suppliers, the delivery times indicated on the product sheets and on the order pages are valid subject to stock shortages or delivery delays attributable to the supplier. They are confirmed by email and/or telephone when an appointment is made for delivery.
Deliveries are made outside weekends and public holidays, and during normal working hours.
Shipping times are subject to collection requirements depending on the payment method chosen (see article 3.2).
For orders of products with several deliveries, each distinct part of the order will be delivered on the basis of the longest lead time of the products making it up.
Despite the care taken with deliveries, TEMPO MATERIAUX SRL cannot be held responsible for the consequences of late delivery or loss of packages caused by a third party or by the Customer, or in the event of force majeure or exceptional events (natural disasters, epidemics, strikes, lockouts, etc.) delaying or preventing the delivery of goods.
Any cancellation of an order, for whatever reason, and accepted by TEMPO MATERIAUX SRL, will only entitle the customer to a refund of the sums paid. No compensation can be claimed for this cancellation.

ARTICLE 8. Claims
By signing the delivery note, the Customer accepts the products delivered as is, and therefore no claim for damage incurred during transport will be accepted. It is the customer’s responsibility to carry out all checks and make all detailed reservations on arrival of the order in writing on the delivery note presented in the presence of the driver.

ARTICLE 9. Late payment and ownership of products
Payment is due in full as soon as the order is placed. Amounts collected cannot be considered as deposits. An order will be considered complete when all products have been shipped and TEMPO MATERIAUX SRL has received the price of the products ordered and your contribution to shipping costs. Total or partial non-payment of a due date will result in immediate payment, without formal notice, of all sums due, even at term, on the date of default, with interest at the legal rate. Our company reserves the right to refuse to make a delivery or to honour an order in cases where you have not paid in full or in part for a previous order, or in cases where a payment dispute remains.
TEMPO MATERIAUX SRL retains full ownership of the products on sale until full payment of all sums due for your order (including taxes and charges) has been received.
However, once the goods have been received, the risk is transferred to you. You must therefore ensure that these goods are well preserved.

ARTICLE 10. Warranties
Legal warranties
All Products for sale on the wwww.trappedevisite.be Site are covered by the legal guarantee of conformity (L211-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), allowing you to return defective or non-compliant Products. You are informed that “Our company” guarantees the conformity of the Products to the contract within the framework of these two legal guarantees.
You have a period of two years from delivery of the Product to take action under the legal warranty of conformity.
In this case, you will be able to choose between repairing or replacing the Product, subject to the cost conditions set out in article L 211-9 of the French Consumer Code.
You do not need to prove the existence of a lack of conformity for six months following delivery of the Product. This period is extended to twenty-four months from March 18, 2016, except for used goods.
Please note that the legal warranty of conformity applies independently of any commercial warranty that may be granted by the manufacturer or TEMPO MATERIAUX SRL.
In addition, you may decide to invoke the warranty against hidden defects in the item sold, as defined in article 1641 of the French Civil Code. In this case, You may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.
– Article L211-4 of the French Consumer Code: The seller is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter is his responsibility under the contract or was carried out under his responsibility.
– Article L211-5 of the French Consumer Code: To conform to the contract, the good must :
1) Be fit for the use ordinarily expected of similar goods and, where applicable :
– correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
– have the qualities that a purchaser may legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2) Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
– Article L211-12 of the French Consumer Code (Code de la Consommation): Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.
– Article L211-16 of the French Consumer Code: When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the purchase or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the date of the buyer’s request for service, or from the date the goods in question are made available for repair, if the goods are made available after the request for service.
– Article 1641 of the French Civil Code: The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he been aware of them.
– Article 1648 al 1er du Code Civil: The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
– Article 1644 of the French Civil Code: The buyer has the choice of returning the item and having the price refunded, or keeping the item and having part of the price refunded.

Contractual warranties
The contractual warranties relating to the Products, and their conditions of application, are fixed by the supplier of the Product. Contractual warranties are therefore likely to differ (duration, scope, etc.) depending on the Products, suppliers and brands. The customer will find details of these warranties on the Product presentation sheet attached to the Product, and specified in the instructions for use or any other document accompanying the Product.
The warranty period begins on receipt of the Products.
In general, our company informs the customer that the contractual warranty offered by suppliers does not cover :
– Malfunctions resulting from improper use and/or maintenance of the product.
– Malfunctions due to normal wear and tear of the Products and replacement of accessories, wearing parts and consumables.
– Damage caused by impacts to products.
Routine maintenance operations (oil changes, adjustments, sharpening, etc.) are not covered by the contractual warranty offered by suppliers.
Independently of the contractual warranty granted, the Products remain guaranteed under the legal warranty of conformity and the legal warranty of defects as defined in articles L.211-4 et seq. of the French Consumer Code and 1641 et seq. of the French Civil Code.

After-sales service for contractual warranties
Only products under warranty are taken into account by the after-sales service.
In order to apply this warranty, please contact the after-sales service department by e-mail at contact@wwww.trappedevisite.be, specifying the disorders observed and the conditions in which they appear. The department will then contact the customer by telephone to arrange the return of the faulty goods. Where applicable, the customer must allow Our company every facility to proceed with the material ascertainment of such defects.
You are responsible for return postage costs.
Products repaired under warranty will be returned to the customer at TEMPO MATERIAUX SRL’s expense.
However, if the warranty does not apply, a quotation will be sent to the customer and no repairs will be carried out without the customer’s agreement. The product will be returned to the Customer at his expense.

ARTICLE 11. Right of withdrawal
How to exercise your right of withdrawal
In accordance with the regulations in force, for any purchase of Product made on the Site, the consumer has a withdrawal period of fourteen (14) calendar days to return the products that do not suit him.
A consumer is defined as a person over the age of eighteen (18) with full legal capacity who is acting for purposes which are outside his or her trade, business, craft or profession. If you are a professional, i.e. a person who orders products for the needs of his or her professional activity, such as a self-employed entrepreneur or a builder, you are not a consumer and cannot benefit from the right of withdrawal.
The withdrawal period runs from receipt of the product, or of the last product delivered in the case of an order for several products.
Once this period has expired, the consumer no longer has the right of withdrawal.
When this period expires on a weekend, public holiday or day off, it is extended until the next working day.
Returned products must be intact and complete, and must not have been subject to extended shipping.
To exercise his right of withdrawal, the consumer may use the standard withdrawal form available on the wwww.trappedevisite.be website, or make any unambiguous statement indicating his intention to return the product. TEMPO MATERIAUX SRL will acknowledge receipt of the cancellation by e-mail.
The consumer must then return the products to TEMPO MATERIAUX SRL, at the latest within 14 days of retraction, to the address given to the consumer by TEMPO MATERIAUX SRL and corresponding to the address of the sender of the products, the return costs being borne by the consumer (with the exception of a defective product upon receipt or an error by TEMPO MATERIAUX SRL when sending the product).
– For bulky products that cannot be returned by post, the return will be at the consumer’s expense. TEMPO MATERIAUX SRL will, at the consumer’s request, organize the return of the goods if the consumer calls 0388261571 (cost of a local call). It being specified that the return costs will in any case be borne by the consumer.
TEMPO MATERIAUX SRL will reimburse the consumer for all products returned upon receipt of the products or proof of their return to the address indicated by TEMPO MATERIAUX SRL.
TEMPO MATERIAUX SRL will reimburse the consumer for the cost of standard “Outbound” delivery of the products if the entire order is returned. Deliveries with a surcharge are reimbursed up to the standard delivery charge. If the consumer does not return the entire order and retains one or more of the products ordered, TEMPO MATERIAUX SRL will not refund the amount of the “Outbound” delivery charges.
In the event of initial payment by credit card, the consumer will be re-credited with the amount directly to his/her credit card. For all other means of payment, or in the event of failure or impossibility of the preceding refunds, the refund will be made by cheque sent to the billing address.
Products excluded from the right of withdrawal
In accordance with the provisions of article L.121-20-2 of the French Consumer Code, the following products are not subject to the right of withdrawal:
– Products which, due to their nature, cannot be reshipped or are likely to deteriorate or expire rapidly. These products are generally understood to include the following: concrete, aggregates, sand, cement, plaster, rendering, patching, etc.
– Made-to-measure” products, i.e. products made to your specifications or clearly personalized.
– Standard products (from 200×200 to 600×600) are exchangeable if the product is not unpacked. They are non-refundable.
– Custom-made products are neither exchangeable nor refundable.

ARTICLE 13. Confidential information
TEMPO MATERIAUX SRL undertakes that any information it collects concerning the Customer’s use of the e-commerce service to purchase or obtain a product, which identifies the Customer, will be treated as TEMPO MATERIAUX SRL’s confidential information. Notwithstanding the foregoing, it may disclose aggregate statistics and general demographic information about the Customer and its business that do not identify or refer to the Products or otherwise use or refer to a TEMPO MATERIAUX SRL trademark, trade name or logo.

ARTICLE 14. Privacy policy
TEMPO MATERIAUX SRL, publisher of the wwww.trappedevisite.be website, respects the privacy of its users and customers and complies strictly with current laws on the protection of privacy and individual liberties.
TEMPO MATERIAUX SRL undertakes not to divulge to third parties any information provided by the Customer. This information is confidential and will only be used for transaction purposes. Consequently, in accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and object to personal data concerning them.
The Customer may refuse to receive promotional messages from TEMPO MATERIAUX SRL’s commercial partners when registering, ordering or, once registered, by modifying his personal information online.
TEMPO MATERIAUX SRL reserves the right to inform its customers by e-mail about the development of its own services or commercial offers.
The Customer may delete his registration. TEMPO MATERIAUX SRL will not store any personal information about the Customer except for accounting information.
The Customer undertakes to use the information thus obtained only for lawful purposes, in accordance with the legislation in force, and to comply with the general conditions set out above or any other indication given within the framework of these general conditions.
TEMPO MATERIAUX SRL reminds you that information intended for the Customer must not be disclosed to a third party. The customer will be held responsible for any unauthorized use of this confidential information.
TEMPO MATERIAUX SRL uses the Customer’s personal information, which has been collected and processed as part of the Customer’s registration, to provide the services offered by TEMPO MATERIAUX SRL. In the event of legal provisions requiring the customer’s specific consent to the communication of specific data, the customer may refuse to give his consent by clicking on the corresponding button to deactivate it during registration. The agreement given by the Customer may be revoked at any time by sending an e-mail to the Customer Service Department.

ARTICLE 15. Warranties – limited liability
The Customer uses the services of the wwww.trappedevisite.be website at its own risk. TEMPO MATERIAUX SRL cannot guarantee that the services offered will be uninterrupted. TEMPO MATERIAUX SRL’s obligation to supply is limited to an obligation of means.
The items offered comply with current French legislation. TEMPO MATERIAUX SRL shall not be held liable in the event of non-compliance with the legislation of the country where the products are purchased.
TEMPO MATERIAUX SRL shall not be liable for any of the following, in addition to the limitations or exclusions of liability set out in these general terms and conditions of sale (i) losses that were not caused by a fault on its part, or (ii) commercial losses (including loss of profit, earnings, contracts, anticipated savings, data, goodwill or unnecessary expenditure), or (iii) any indirect or consequential loss not foreseeable by the parties.
TEMPO MATERIAUX SRL shall not be liable for any delay or impossibility for the Customer to fulfil its obligations under these conditions if the delay or impossibility results from a cause outside TEMPO MATERIAUX SRL’s control or from force majeure.

ARTICLE 16. General provisions
Modifications and waivers. TEMPO MATERIAUX SRL reserves the right to modify the general conditions of use. TEMPO MATERIAUX SRL will inform the Customer of the changes by e-mail and invite the Customer to agree to the changes.
Notification. Any notice required or permitted by the General Terms and Conditions shall be in writing and shall be deemed sufficient upon receipt, if personally addressed by mail, 24-hour delivery service or confirmed fax, or forty-eight (48) hours after mailing by return receipt requested (by airmail in case of overseas shipment), postage prepaid, if such notice is sent to the addressee at the addressee’s address or fax number as indicated on the contract signature page or as subsequently modified by written notice.
Assignment. The Customer may not transfer to a third party any information provided, the use of which is reserved for strictly personal use.
Applicable law. The terms and conditions, all acts and transactions hereunder and the rights and obligations of the parties hereto shall be governed by and construed in accordance with French law, and the parties consent to the jurisdiction of France.
Jurisdiction. If the parties are unable to settle any dispute relating to the general terms and conditions within fifteen (15) days following written notification by one of the parties to the other concerning the said dispute, the dispute will be settled by the competent court. The out-of-court settlement phase does not interrupt the limitation period.
Autonomy of contract clauses. In the event that any provision of the General Terms and Conditions is deemed inapplicable under applicable law, the parties agree to renegotiate it in good faith in order to preserve the economic position from which they benefit as close as possible to that mentioned under the provision rendered inapplicable. If they are unable to replace this provision in a mutually acceptable and enforceable manner, (i) this provision shall be excluded from the General Terms and Conditions, (ii) the remainder of the terms and conditions shall be construed as if the said provision were excluded, (iii) the remainder of the terms and conditions shall apply in accordance with the terms and conditions of the latter.
Full agreement. These General Terms and Conditions constitute the entire agreement between the Customer and TEMPO MATERIAUX SRL with respect to the subject matter hereof.
Force majeure. Neither TEMPO MATERIAUX SRL nor any third party involved in the provision of the service shall be liable for any failure or delay in the performance of their obligations under the terms and conditions, resulting from causes beyond their reasonable control, including but not limited to force majeure, riot, insurrection, war, act of God, strike, lock-out, power failure or blackout lasting more than 24 hours, breakdown of communications networks, epidemics, fire, landslides, floods, lightning damage, traffic accidents, transportation interruptions or delays, TEMPO MATERIAUX SRL’s inability to obtain supplies, acts of sabotage, network failures, electronic file encoding errors, software limitations or inability to obtain telecommunication services or governmental measures, provided, however, that the parties concerned take all reasonable steps to mitigate the effects resulting from such situations.
Basis for negotiation. The Customer and TEMPO MATERIAUX SRL acknowledge and agree that the exclusions of warranties and limitations of liability and remedies contained in the General Conditions are material and form the basis of the General Conditions.
Definitions: “Customer” means a natural person who registers and/or subscribes with TEMPO MATERIAUX SRL for the purpose of purchasing products distributed by TEMPO MATERIAUX SRL on wwww.trappedevisite.be and its related sites using the same database. “Customer Personal Information” means the name, e-mail address, company name and billing address (to the extent TEMPO MATERIAUX SRL collects such information) of a Customer.”Information Providers” means the third party providing the information contained in TEMPO MATERIAUX SRL’s services.”Information” means text and images.”Price” means the purchase price of the Product.

ARTICLE 17. Applicable law and competent court
The General Terms and Conditions of Sale are subject to French law in their entirety. All disputes arising from the business relationship between the customer and TEMPO MATERIAUX SRL shall be subject to the exclusive jurisdiction of the French courts.
In the event of a dispute, an amicable solution will first be sought. The customer is hereby informed that he/she may in any event have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation (C. consom. art. L 534-7) or with existing sectoral mediation bodies, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.
Seeking an amicable solution does not interrupt the contractual warranty, but it does interrupt the time limits for action available to the customer.
